Iarnród Éireann Granted Injunction to Stop Use of Arklow UnderpassSaturday, March 17 2007The High Court has granted an interim injunction to Iarnród Éireann preventing the developer of a wastewater treatment plant from using a railway underpass near Arklow, Co Wicklow.
Iarnród Éireann claimed Fred Daly had excavated parts of the underpass near Arklow train station and was using it for heavy construction traffic. The court was told construction work was causing safety concerns for the Dublin-Wexford railway line. The company said the underpass was only ever intended for cattle and light agricultural traffic. Iarnród Éireann said it is monitoring the underpass to check there had been no settlement of the railway line, but said there is no risk to passengers. |
